Employment Law Mirsafian Law Group focuses on the representation of victimized employees throughout Illinois. Federal and state laws prohibit employers from retaliating against an employee as a result of an employee’s objections to illegal employment practices. Likewise, it is illegal for an employer to retaliate against an employee who has filed a Charge of Discrimination, testified, or assisted federal or state authorities responsible for investigating or prosecuting an employer for illegal employment practices. The law also prohibits employers from engaging in illegal post-employment retaliation against former employees who filed Charges of Discrimination. If you believe that you have been illegally discriminated against because of your race, age, religion, gender, national origin, or because you are pregnant, or as a result of a disability, you should contact Mirsafian Law Group immediately to discuss your employment law matters, including: Discrimination (race, age, religion, gender, pregnancy, disability, national origin, and other protected classes); Sexual harassment; Retaliation; Family Medical Leave Act claims; Non-compete agreements; Employment contracts & severance agreements; Whistleblower claims; Unpaid wages and overtime compensation; Fair Labor Standards Act claims; Developing business manuals and handbooks
If you feel you may have been wronged by your employer,
Retaliation State and federal laws protect whistleblowers from retaliation by co-workers and employers. In fact, Illinois law specifically prohibits an employer from retaliating against an employee for refusing to participate in an activity that would result in a violation of a state or federal law, rule, or regulation.
Illinois law also prohibits an employer from making, adopting, or enforcing any rule, regulation, or policy preventing an employee from disclosing information to a government or law enforcement agency if the employee has reasonable cause to believe that the information discloses a violation of a state or federal law, rule, or regulation.
Violations of the Illinois Whistleblower Act constitute a criminal misdemeanor, and also provide for potential civil claims.
An employee who successfully brings a claim under certain provisions of the Illinois Whistleblower Act is entitled to reinstatement, back pay, actual damages, attorneys' fees and costs.
If you believe that you have been illegally retaliated against,
Whistleblowers Whistleblowers are as people who come forward with information regarding the submission of false claims to state or federal authorities seeking reimbursement to which they are not entitled. Federal and state laws prohibit employees from being retaliated against for disclosing information regarding the submission of false claims. Whistleblowers are typically entitled to a percentage of any recovery made by the government.
Common whistleblower examples include people who come forward with information regarding:
• Fraudulent Medicaid and Medicare billing
• Doctors’ offices and/or hospitals fraudulently billing the Government for services performed by non-physicians
• Medicaid and Medicare “upcoding” (coding that violates the Government's reimbursement rates)
• Fraudulently billing the Government for services and supplies never rendered or not rendered under agreed terms
• Overcharging the Government for services and supplies
• Illegal doctor "kickback" fees paid in exchange for referrals or prescriptions
• Falsifying material facts or credentials to secure and maintain government contracts
• Unbundling (using multiple billing codes instead of one billing code for a drug panel test in order to increase remuneration)
• Bundling (billing more for a panel of tests when a single test was ordered)
If you have information relating to the submission of false claims,
